Student information and documentation obtained by Student Disability Services (SDS) are student education records and are protected under the Family Educational Rights and Privacy Act of 1974 (FERPA). Although certain medical records are exempt from FERPA’s definition of “education records,” that exemption does not apply to the records obtained by SDS. Accordingly, SDS’s records will be treated as confidential records in accordance with FERPA regulations.
Since the paper records obtained from students or other sources are confidential, they are secured in a locked cabinet. In addition to paper files, SDS maintains electronic information on students and this is also confidential pursuant to FERPA. Information about disabilities and the use of accommodations is not disclosed on student transcripts. In accordance with FERPA, disability related documents created by SDS will not be released to persons who are not school officials without written consent of the student, unless a FERPA exemption applies.
